This Privacy Policy Applies to Our Canadian Operations

This Privacy Policy describes how we, with your express or implied consent or as otherwise permitted or required by law, may collect, use, disclose, protect and otherwise process your Personal Information when you ask about, apply for, or obtain a financial product or service from us, or file or are otherwise subject to a claim under a financial product or service. By purchasing or applying for our products and services, or providing your Personal Information to us in relation to a claim filed by you or another person, you are giving your consent to our collection, use and sharing of your Personal Information in accordance with this Privacy Policy. Subject to applicable law, you may withdraw your consent to our use or disclosure of your Personal Information by contacting us as indicated below. However, if you do so, our ability to provide, or continue to provide, products, coverage and/or services to you may be affected.
 

Personal Information Collection and Use

In general, we collect Personal Information to:
a) service your business dealings with us, such as your requests for (i) our products or services (an “Application”), (ii) us to pay or defend a claim, and (iii) us to take action on your account, (collectively, the “Transactions”);
b) support our business functions; and
c) with your consent, send you communications by mail, email or telephone marketing or promote products and services that may be of interest to you. You can opt-out of receiving marketing email communications at any time by clicking on the unsubscribe link included in our marketing email communications or by contacting us as set out under How to Contact Us below. Please note that if you unsubscribe, you may continue to receive certain transactional or account-related communications from us.

We may obtain Personal Information from:
a) You, such as in connection with your Transactions with us; and
b) Third parties, such as a consumer reporting agency, insurance brokers or agents, government authorities, employers, or external investigators when investigating claims (which may include information gathered through surveillance).

Based on the type of product or service You apply for or get from us, we may collect and use your Personal Information to:
a) underwrite policies, including information relating to your application for insurance for the purpose of evaluating your request for a quote;
b) process claims, including personal information relevant to your claim for damages or injuries for the purpose of adjusting and responding to your claims,
c) facilitate payments, including your personal contact information and your financial account information as required to issue payments to You,
d) develop new products and services, including information about You and your business for the purpose of identifying and developing new products and services,
e) advise you of new products and services including information about You or your business, and your contact information in order to provide You with information, including through marketing communications,
f) detect or prevent fraud, including contact information and information about your damages or injuries in order to detect and prevent fraud, and
g) conduct a credit check with your consent in order to obtain your credit score from a consumer reporting agency. Your credit report may include information such as the types and amounts of credit advanced to you, payment histories, negative banking items, collection actions, legal proceedings, previous bankruptcies and other information reported by your creditors. You authorize credit reporting agencies to provide such information to us. We use this information to determine your eligibility for some of our products and services.
 

Sharing of Personal Information

To serve you and service our business, we may share certain Personal Information with our affiliates and third-parties including affiliates such as our insurance companies, our employee agents, our brokerage firms, and our administrators; and including third parties such as contractors, agents, external investigators, or administrators under contract to perform services on our behalf, with independent agents, brokerage firms, and insurance companies to serve you; and service providers to administer or investigate claims, to store Personal Information, market our products or services, or administer surveys.

We only transfer or disclose Personal Health Information in connection with your Transactions with:
a) your written authorization; or
b) as otherwise allowed or required by law.

Your Personal Information may be maintained and processed by us or our affiliates and other third party service providers outside of Canada (and, for residents of Quebec, outside of Quebec), including in the US or other foreign jurisdictions. Third parties are given the information they need to perform their designated functions, and we do not authorize them to use, disclose or otherwise process Personal Information for their own marketing or other purposes. If your Personal Information is shared, stored and/or processed in foreign jurisdictions, your Personal Information may be subject to the foreign jurisdiction’s laws and available to its courts, regulatory agencies and law enforcement authorities.
With your consent or when allowed by law, we may use or share certain Personal Information with third parties who a) market our products or services or b) offer financial products or services, under a joint marketing agreement between us and one or more financial institutions. We will not sell or share your Personal Information with anyone for these optional purposes without offering you the opportunity to:
a) “opt out”; or
b) “opt-in”;
as required by law.

We may transfer any information we have about you as an asset in connection with a proposed or completed merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of Hartford or as part of a corporate reorganization or other change in corporate control.

We may otherwise provide your Personal Information in response to a search warrant or other legally valid inquiry or order, in the case of a breach of an agreement or contravention of law, or as required or permitted by applicable Canadian, US or other law. We may also disclose Personal Information where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspect loss or harm to persons or property.
 

Safeguarding Your Information

We have implemented technical, physical and administrative safeguards designed to maintain:
a) the confidentiality; and
b) the integrity of
Personal Information in our custody or control. We use these procedures to guard against theft, loss, unauthorized access, use, modification and disclosure of such Personal Information.
 
We:
a) identify information to be protected; and
b) provide an adequate level of protection appropriate to the sensitivity of the Personal Information.
 
Some techniques we use to protect Personal Information include: secure files and transfers; user authentication; encryption; firewall technology; and the use of detection software.
 
Our employees have access to Personal Information in the course of doing their jobs. We limit access to your Personal Information to those employees who require such access to perform their job-related duties. Employees who violate our Privacy Policy will be subject to discipline, which may include ending their employment with us.
 

Changes to This Privacy Policy

This Privacy Policy may be updated periodically to reflect changes to our Personal Information practices. The revised Privacy Policy will be posted on our website, and is available upon request.
 
We will continue to follow our Privacy Policy regarding Personal Information even when a business relationship no longer exists between us.
 

Exercising Rights to Your Information; Retention of Your Information

We are committed to the use of accurate Personal Information. Subject to applicable law, you may request access to, or portability of, your Personal Information and seek updating and correction of any inaccurate Personal Information we have in our custody or control by emailing or writing to us at the contact information set out below. However, such access may be limited where we are under legal restrictions on disclosure or need to protect our rights and those of other persons, such as:
 
  • Information subject to a legal privilege;
  • Where disclosure would likely reveal personal information of a third party;
  • Where disclosure would reveal our confidential information;
  • Where disclosure would likely compromise the security of another person or of an investigation concerning a claim or other legal matter; or
  • Where disclosure would violate applicable law or a properly issued court or administrative order.
We may request certain Personal Information for the purposes of verifying the identity of the individual seeking access to, or portability of, their Personal Information records.

We retain Personal Information for so long as is required to enable us to fulfill all of the purposes for which such information was collected or as otherwise required to meet our legal, business and contractual obligations (e.g., audit purposes or to resolve disputes).
